GLITZY GIFTING TERMS & CONDITIONS 

Terms of Use

By accessing or placing an order through Glitzy Gifting (the “Platform”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Platform.

1. Marketplace Services

Glitzy Gifting curates products offered by independent partner vendors and facilitates ordering and delivery through third-party courier providers.

Product availability may change without notice.

2. Orders

All orders are subject to acceptance and availability.

We may decline or cancel an order if:

• A product is unavailable

• Delivery cannot be completed to the requested address

• Fraud or payment concerns arise

• Information provided is inaccurate or incomplete

3. Same-Day Delivery

Glitzy Gifting offers same-day delivery for eligible orders placed before stated cutoff times.

Any stated delivery window (including “within 4 hours”) is a good-faith target, not an absolute guarantee, and may be affected by traffic, weather, building access, recipient availability, vendor readiness, or other circumstances outside our reasonable control.

4. Recipient Availability / Failed Delivery

Customers are responsible for providing accurate recipient and delivery information.

If delivery cannot be completed due to recipient unavailability, building access restrictions, incorrect information, refusal of delivery, or circumstances outside our reasonable control, Glitzy Gifting may:

• Contact the purchaser for instructions;

• Leave the gift in accordance with delivery preferences provided;

• Reschedule delivery where feasible; or

• Treat the delivery attempt as completed where delivery was attempted in accordance with customer instructions.

Additional delivery fees may apply for redelivery.

5. Third-Party Couriers

Delivery may be performed by independent third-party couriers.

Glitzy Gifting does not guarantee the acts or omissions of independent courier providers, though we will work in good faith to address service issues.

6. Product Presentation and Substitutions

Products are provided by partner vendors.

No substitutions will be made without approval, except where a minor packaging or presentation adjustment is reasonably necessary and does not materially change the product.

7. Pricing, Taxes, and Fees

Prices are shown before applicable taxes unless otherwise stated.

Applicable sales tax and delivery fees may be added at checkout.

8. Returns and Refunds

Because many products are perishable, time-sensitive, custom, or curated for same-day delivery, all sales are generally final.

If there is a problem with your order, contact us promptly and we will work in good faith to make it right where appropriate.

Refunds or credits, if issued, are at our reasonable discretion except where required by law.

9. User Content

If you submit gift messages, delivery instructions, reviews, or other content, you represent you have the right to submit it and that it does not violate any law or third-party rights.

10. Intellectual Property

The Platform, including text, branding, design, and content, is owned by or licensed to Glitzy Gifting.

11. Limitation of Liability

To the maximum extent permitted by law, Glitzy Gifting’s aggregate liability arising out of or relating to any order shall not exceed the amount paid for the order giving rise to the claim.

Glitzy Gifting shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Disclaimer

Services are provided on an “as available” basis.

We make no warranties, express or implied, except as required by law.

13. Privacy

Your use of the Platform is also subject to our Privacy Policy, which describes how we collect, use, and protect personal information, including customer names, addresses, payment-related information processed through third-party providers, and order information.

14. Prohibited Uses

You agree not to use the Platform for any unlawful purpose, fraud, harassment, abuse, interference with the Platform, or violation of others’ rights.

15. Dispute Resolution (Informal Resolution First)

Before initiating formal legal proceedings, you agree to contact us and attempt in good faith to resolve any dispute informally. The parties will seek to resolve disputes within five (5) business days after notice where reasonably possible.

16. Force Majeure

Glitzy Gifting shall not be liable for delays or failures caused by events beyond our reasonable control, including severe weather, natural disasters, pandemics, strikes, transportation disruptions, governmental actions, or similar events.

17. Account Suspension or Termination

If customer accounts are offered, we may suspend or terminate accounts for suspected fraud, abuse, violation of these Terms, or other misuse of the Platform.

18. Changes to Terms

We may update these Terms from time to time by posting revised Terms on the Platform.

19. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles.
